This Privacy Policy describes the types of information gathered by 77X, LLC (“Company,” “us,” “our,” or “we”) in the process of providing, running, and maintaining 77x.world (the “Site”), our Model(s) (as defined below, and if applicable), and the data, services, information, tools, functionality, updates and similar or related materials (collectively, the “Service”), how we use the information, with whom the information may be shared, what choices are available to you regarding collection, use and distribution of information and our efforts to protect the information you provide to us through the Service.

By accessing the Site, using the Service, or otherwise providing information to us, you hereby consent to allow us to collect, use, process, and disclose your information in accordance with this Privacy Policy. When accessing the Site, please also refer to our Terms of Service, available here, 77x.world, which are incorporated into this Privacy Policy as if fully recited herein. Terms defined in the Terms of Service that are not defined herein shall have the same definition as in the Terms of Service.

This policy is subject to change. If our information retention or usage practices change, we will let you know by posting the Privacy Policy changes on the Site and/or otherwise making you aware of the changes. Your continued use of the Site, or Service, following our notice of changes to this Privacy Policy means you accept such changes. Please refer to the “Effective Date” above to see when this Policy was last updated.

Territoriality

Regardless of where our servers are located, your personally identifiable information, may be processed by us in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world. BY VISITING THE SITE AND USING OUR SERVICE, YOU UNEQUIVOCALLY AND UNAMBIGUOUSLY CONSENT TO THE COLLECTION AND PROCESSING IN THE UNITED STATES OF ANY INFORMATION COLLECTED OR OBTAINED BY US THROUGH VOLUNTARY SUBMISSIONS, AND, TO THE EXTENT POSSIBLE, THAT U.S. LAW GOVERNS ANY SUCH COLLECTION AND PROCESSING.

This Privacy Policy may be subject to the provisions of the EU General Data Protection Regulation (“EU GDPR”), the UK General Data Protection Regulation (“UK GDPR”, and together with the EU GDPR, the “GDPR”), the California Consumer Privacy Act of 2018, as amended (“CCPA”), and other applicable privacy laws. If you are an individual who resides in the United Kingdom, the European Economic Area, or Switzerland (collectively, and for the purposes of this Privacy Policy, the “EEA”), you are a “Data Subject” with certain protected privacy rights concerning your “Personal Data” and we are a “Controller” according to the GDPR. Similarly, under the CCPA, we are a “Business” and you, if you are an individual residing in California, are a “Consumer” with certain protected privacy rights concerning your “Personal Information.” We will take commercially reasonable steps to maintain compliance with the GDPR, the CCPA, and all other applicable laws. Your Personal Data and/or Personal Information, combined with any other information that may identify you as a person, may be referred to in this Privacy Policy as Personally Identifiable Information (collectively, “PII”). If you are a Data Subject, read Sections 14 and 15 below, and if you are a Consumer, please read both Sections 14 and 16. For the purpose of this Privacy Policy, PII does not include de-identified or aggregated information that does not identify you.

1. Collection, Use, and Disclosure Information

We may collect certain PII from you when you visit or browse our Site or use our Service. It is important to note that the type of information collected will depend on your location and your interaction with the Service.

2. Who Collects Your Information On Our Site?

We do. We collect information from you when you visit or browse the Site, use our Service, sign-up for our mailing list, sign-up to receive more information about the Company, or place an order. We are responsible for the protection of your information. We collect PII from three different sources: directly from you; from third-party sources (for example, Google OAuth or Apple ID); and automatically collected information.

3. What Information Do We Collect?

A. Personal Information

We collect certain PII or data about you, which may be supplied when you sign-up for the Site, when you complete a survey, when you create or update an account, when you use the Site, when you fill out a form available on the Site, when you make a purchase via the Site, when you request the Service, when you link your account on the Service to your social media account(s) via our optional integration, or otherwise when you submit such information. The types of PII we collect and save include:

  • Name, email address, mailing address, phone number, certain demographic information including gender (identity), location, employment information, username, and in some cases, and your date of birth;
  • Purchasing history and content engagement; and
  • Technical information collected in our logs. Such information may include standard web log entries that contain your IP address, device identifiers, first-party Cookies (session, and persistent), third-party Cookies, web beacons, pixels, page URL and timestamp.

You may provide us with information when you interact with us through email, read an email from us, use our online chat or messaging functions within the Site, Service, or otherwise when you interact with us. We may retain such information in order to provide you with the Service, and you agree that we may share this information as needed with other users in order to resolve any issues that may arise between you and another user of the Service.

The Service may offer you the option to be integrated with third-party social media platforms, such as Facebook, Instagram, and others (“Platforms”). If available, and you choose to interact with the Platforms through the Service, the Platforms may make additional PII about you available to us. The Service may use your mobile data plan in order to use certain features of the Service, such as communication with other users through the Service.

B. Non-Personal Information

“Non-Personal Information” is information which doesn’t identify you and/or anonymous information about you, including but not limited to links and materials posted, purchase history, the type of device you used and its operating system, browser information, the pages accessed most frequently, how pages are used, applications downloaded, search terms entered, and similar Non-Personal Information.

Automatically tracking Internet Protocol (IP) addresses is one method of automatically collecting information about your activities online and information volunteered by you. An IP address is a number that is automatically assigned to your device whenever you surf the internet. Further, the Site and Service may utilize web beacons, pixel tags, Cookies, embedded links, and other commonly used information-gathering tools. Through collecting your IP address, we may be able to approximate your geographic location, however, unless and until this information is paired with your PII, it cannot be used to identify you. If Non-Personal Information is paired to any of your PII, we will treat the Non-Personal Information as if it was PII.

Part of the purpose of the Site is to share materials you make available. Anything you publicly post will not be considered PII.

C. Aggregate Information

We may also collect anonymous, non-identifying and aggregate information, the date and time of any request, language preference, referring website, the website you go to after visiting our Site, and the domain name of your Internet provider.

D. Financial Information

Although it may appear that we collect financial information from you on the Service, it is actually collected and processed through a third-party service provider (“Payment Processor”) to process payments for the Service. The Payment Processor may collect financial information such as banking information, credit card number, name, CVV code, and/or Credit Card date of expiration, from you on the Service. We do not hold your financial information.

4. Why Is My Information Being Collected?

We accept and gather information in an effort to provide better services to you. We collect your PII so that we can respond to your requests for information or so that you can be added to our email and SMS lists, we can curate a personalized experience for you with the Services, to confirm your eligibility to participate in Contests (as defined below), and for us to process any payments made in connection with the Service, and, to train, develop, and improve the artificial intelligence and/or machine learning models and algorithms that we create or use (collectively, “Models”), if applicable. We also collect aggregate information to help us better design the Site. We collect log information to help us diagnose problems with our servers, administer the Service, calculate usage levels, and otherwise provide services to you.

5. How Do We Use the Information We Collect?

A. PII

We use the PII you provide for the purposes for which you have submitted it including:

  • Internal Uses. We may use your PII to respond to your inquiries, to fulfill your requests for information, track usage trends, conduct experiments, send you push notifications, develop and improve the Site and any related services or offerings, perform research and analytics, compile usage statistics and other data regarding the use of our Site and Service, ensure the security of the organization and our visitors, and abide by any applicable laws.
  • Personalizing Experience. We may use your PII to craft and personalize your experience with the Service including, but not limited to, targeted advertising.
  • Creating and Maintaining Your Account. We use your PII to create and maintain an account for you to allow you to make payments and access any other aspect of the Service offered by and related to the Company. We may engage, directly or indirectly, a service provider to assist in maintaining and permissioning your account, or access, generally.
  • Processing Payments. Our Payment Processor uses your PII to transfer funds from your account(s) when you purchase merchandise (“Merchandise”) through our e-commerce store (operated by our Payment Processor) (“Store”) to pay the Merchandise manufacturer (“Manufacturer”).
  • Training AI. As mentioned above, if and when the Service uses artificial intelligence, we may use your PII and your Content to develop and improve the Service, including for the training of the Model(s) that power(s) our Service.
  • Communicating With You About the Service. We may use your PII to send you information about, and notify you of, exclusive offers and provide you information regarding your recent purchases, updates about Luka Dončić, Contests, and new Merchandise.
  • Social Media Integration. If available, and you choose to integrate, we may use your PII to integrate your social media accounts with the Service, and to provide you the social media features of the Service.
  • Inviting Your Contacts. We may use your PII to allow you to invite your friends and contacts to use the Service, or participate in our Contests, in response to your request to do so.
  • Sending You Administrative and Promotional/Marketing Emails. We may use your PII to send you emails to: (a) confirm your account information and your other PII; (b) provide you with information regarding the Service; (c) inform you of changes to this Privacy Policy, our Terms of Service, or our other terms, conditions, or policies; (d) let you know about Merchandise in our Store that might interest you; or (e) provide you with information about promotions, contests, or other special events (collectively, “Contests”), which may or may not be related to our other services and products, and which may be subject to additional terms and disclosures.
  • Contests. We may collect your PII, including your approximate age, in order to administer and determine your eligibility to participate in Contests and other events and activities that we may host, sponsor, or promote. We may engage, directly or indirectly, a service provider to otherwise setup, sell, manage, and run Contests with which we are involved, sponsor, host, or promote.
  • Serving You Targeted Advertisements and Profiling. We may use PII to serve you advertisements with the Service, and other communications, that are targeted to your interests and to create a unified profile about you to determine what you may do or want in the future.
  • Personalized Engagement. If you participate in our Fan Pass program, we may use your date of birth to send you well wishes on your birthday, to give you early access to Merchandise, to offer you discounts on Merchandise, or other benefits of a similar nature, as we may decide, from time to time.
  • Sending You Text Messages. If you opt in/consent to receiving text messages, we may send you text messages for the following purposes: content or updates, product information, promotional or marketing, Contest administrative purposes, or as we otherwise indicate when you opt in to receiving the text messages.
  • Sharing Information. We may disclose your PII with third parties as described below.
  • Mailing You Something. From time to time, we may send you something relating to the Service via USPS, courier, or another service, including, but not limited to when you purchase Merchandise.
  • Employment Information. We collect and use this information in the event that you provide it to us to be considered for a job posting that we have made, to the extent we interact on a business level, or if you want something delivered to your work address.

B. Anonymous Information

We may use anonymous information that we collect to improve the design and content of our Site, and to enable us to personalize your internet experience. We also may use this information in the aggregate to analyze how our Site is used, as well as to offer you programs or services. We may use any anonymous, aggregate information, of which your information may be a part of or the basis of, without restriction.

6. Do We Share Your PII?

We will not share your PII except: (a) for the purposes for which you provided it; (b) with your consent; (c) as may be required by law or as we think necessary to protect our organization or others from injury (e.g., in response to a court order or subpoena, in response to a law enforcement agency request, or when we believe that someone is causing, or is about to cause, injury to or interference with the rights or property of another); (d) to unaffiliated partners that may help us facilitate the Services or Contests; or (e) with persons or organizations with whom we contract to carry out internal operations or business activities, for example, we may transfer your PII to a partner with whom we engage in targeted marketing/advertising across multiple regions, to create and administer Contests, unrelated websites/platforms, or to a carrier to deliver something to your address.

We may partner with third parties and third-party developed tools to optimize your experience with the Service. These third-party tools enable us to tailor our communications to you for a personalized experience with the Service. Pursuant to our partnership with these third parties, certain PII, including your name, address, phone number, and email address, may be shared with these third parties. From time to time, we may elect to engage different third parties to more efficiently and effectively communicate with you. Your elected data preferences and data privacy settings will be preserved and maintained any time we substitute or add a new third-party partner to provide the Service. If there are any material changes to how we share PII with our third-party partners, we will promptly notify you for your awareness.

We may also add new services or functionality, or modify existing services or functionality, from time to time, which may require your Content and/or PII to be disclosed to one or more companies that provide certain technology tools, functionality, and services (“Third-Party Providers”), or for these Third-Party Provider to collect additional PII or other information from you to provide the tools, functionality, or services. Neither this Privacy Policy, nor our Terms of Service, available here, 77x.world, apply to the services, functionality, or tools that our Third-Party Providers, if any, provide in relation to you. You agree and acknowledge that the actions taken by such Third-Party Providers will be subject to, and governed by, their own terms and policies, including, but not limited to their respective privacy policies. You hereby consent to our sharing your Content and/or PII with the Third-Party Providers as necessary to provide the parts of our Service that you request.

We may also share aggregate information with others, including affiliated and non-affiliated organizations.

Finally, we may transfer your PII to a third party, or an actual or potential successor-in-interest, in relation to, or in the event of, an actual or potential merger, acquisition, sale of all or substantially all of our assets, reorganization, bankruptcy, or other change of control. After such disclosure or transfer, the third party or successor in interest may use the information in accordance with applicable law.

7. Are There Other Ways My PII Could Be Shared?

You may elect to share certain PII with individuals or with the public via your use of the Service. In this case, you will control such sharing via settings that we provide. For example, the Service may make it possible for you to publicly share information via Platforms such as Facebook, or Instagram. Be aware that when you choose to share information with friends, or with the public at large, you may be disclosing sensitive information, or information from which sensitive information can be inferred. Always use caution when sharing information through the Service. You understand and agree that we are not responsible for any consequences of your sharing of information through and beyond the Service.

You may choose to participate in activities offered through the Service that allow you to earn points. If you participate in these activities and accumulate points, we may include your username and point total on a leader board on the Service. We may also display the leader board at a particular event or activity which we are hosting or sponsoring, or in which we are participating.

8. How Can You Access and Control Your Information?

After becoming a user of the Site, you may revise or edit your information by sending an email to privacy@77X.world. For instructions on how you can further access your PII that we have collected, or how to correct errors in such information, please send an e-mail to privacy@77X.world. To protect your privacy and security, we will take reasonable steps to help verify your identity before granting access, making corrections or removing your information. At any time you can email us at privacy@77X.world with “Opt-Out” in the subject to opt out of any of the following activities with respect to your PII: being included in the leader board; profiling you based on your PII; sharing your PII with certain third parties; Selling or Sharing (each, as defined in the CCPA) your PII; serving you targeted advertising; using your PII for purposes other than it was provided for; including you in an online directory; and/or sending you promotional emails.

9. How Do We Store and Protect Your Information?

A. Storage

After receiving your PII, we will store it on our servers for future use. While we have appropriate safeguards in place, unfortunately, no data transmission over the internet or data storage solution can ever be completely secure. As a result, although we take steps to protect your data, we cannot ensure or warrant the security of any information you transmit to or receive from us or that we store on our or our service providers’ systems.

B. Servers Location

If you are visiting the Site from outside of the USA, you understand that your connection will be through and to servers located in the USA, and the information you provide will be securely stored in our servers and internal systems located within the USA.

C. Security

Please note that we protect PII in our possession with strong encryption (at rest and in transit); all data transfers are through secure http protocol, and as such are encrypted. We also restrict access to PII to key employees and log all instances of access to PII. Our Payment Processor is fully PCI-compliant and encrypts all payment transactions using Secure Socket Layer technology.

We use Google reCAPTCHA, which is integrated into the Site, and is provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 (“Google”). Using this Google service helps determine whether certain actions are being taken by an actual person, or by automated software (some of which are known as “bots”), which protects you and the Company. To do this, reCAPTCHA may send some of your data, such as IP Address and Non-Personal Information, to Google as part of its functionality, but such data will not be combined with any other data unless you are also logged into your account with Google. If you use our Site, you agree that Google and its representatives may automatically collect, edit, and use your PII and Non-Personal Information. D. Retention

We will only retain your PII for as long as is reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your PII for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. To determine the appropriate retention period for PII, we consider the amount, nature, and sensitivity of the PII, the potential risk of harm from unauthorized use or disclosure of your PII, the purposes for which we process your PII and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

We store our logs and other technical records and any information entered into our Model(s) (if applicable) indefinitely.

10. How Do We Use Cookies and Other Network Technologies?

A. Cookies

To enhance your online experience with us, our web pages may presently or in the future use “Cookies.” Cookies are text files that our web server may place on your hard disk to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other PII unless you choose to provide this information to us. Once you choose to provide PII, however, this information may be linked to the data stored in the cookie. Although it may be possible to turn off the collection of Cookies through your device or browser, certain features of the Site may not function properly without the aid of Cookies.

B. Third-Party Partner Services

Our Site may use Google Analytics. Google Analytics uses Cookies and similar technologies to collect and analyze information about use of the Site and report on activities and trends. This service may collect information regarding the use of other websites, apps and online resources. We also use Google’s marketing services, which allow us to display ads in a more targeted manner in order to present ads of interest to the users. This is accomplished through Google’s use of Cookies, and all ads are displayed/served to the owner and/or device to which the relevant cookie pertains, whether or not that cookie is linked to any PII. C. reCAPTCHA

This Google service uses cookies as part of its fraud and abuse prevention functionality. D. Pixel Tags

The Company or its service providers may also use “pixel tags,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixel Tags”) in connection with some of our Site pages and HTML-formatted email messages for purposes of, among other things, compiling aggregate statistics about website usage and response rates. A Pixel Tag is an electronic image, often a single pixel (1x1), that is ordinarily not visible to website visitors and may be associated with Cookies on visitors’ hard drives. Pixel Tags allow us and our service providers to count users who have visited certain pages of our Site, to deliver customized services, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted email messages, Pixel Tags can inform the sender of the email whether and when the email has been opened.

E. Meta Pixel

One such Pixel Tag that our Service uses is the Meta Pixel, a web analytics and advertising service, provided by Meta Platforms, Inc., 1 Meta Way, Menlo Park, CA 94025 (“Meta”). With its help, we can keep track of what users do after they see or click on a Facebook or Instagram advertisement, keep track of users who access our Service or advertisements from different devices, and better provide advertisements to our target audiences. Meta may use and disclose (including to Facebook and unaffiliated third parties that provide no services to us) your data collected by the Meta Pixel in accordance with its Data Policy, which can be found at https://www.facebook.com/privacy/policy/. In addition, Meta can save and process your data, connect it with your Facebook and/or Instagram accounts, and use it for its own and others advertising purposes in accordance with the Facebook Data Policy.

F. X Pixel

We use the X Pixel (provided by X Corp., 865 FM1209, Suite A, Bastrop, TX 78602 (“X”)). As used in our Site, the X Pixel tool uses cookies to set a unique ID for users that allows third-party advertisers to target users with relevant advertisements. By using our Site, you consent to the processing of data about you by X in the manner and for the purposes set out above. G. Clickstream Data

As you use the internet, you leave a trail of electronic information at each website you visit. This information, which is sometimes referred to as “clickstream data”, can be collected and stored by a website’s server. Clickstream data can reveal the type of computer and browsing software you use and the address of the website from which you linked to our Site. We may use clickstream data as a form of Non-Personal Information to determine how much time visitors spend on each page of our Site, how visitors navigate through the Site, and how we may tailor our web pages to better meet the needs of visitors. We will only use this information to improve our site.

H. Do Not Track

At present, the Site does not specifically respond to browser do-not-track signals.

11. Collection of Information by Others

Our Terms of Service document identifies certain third-party websites to which we may provide links, and that you may click on our Site or in our Service. Please check the privacy policies of these other websites to learn how they collect, use, store and share information that you may submit to them or that they collect.

12. Children and Young People’s Information

We value and are committed to protecting the privacy of children who use the Service and participate in any Contests that may be hosted by us. As such, we comply with all applicable privacy laws including the GDPR, the CCPA, the Children’s Online Privacy Protection Act (“COPPA”), and associated Federal Trade Commission (“FTC”) rules for collecting PII from minors. COPPA requires us to inform parents and legal guardians (collectively, “Parents”) about how we collect, use, and disclose personal information from children under the age of 13. It also requires that we obtain verified Parental consent before we allow children under the age of 13 to use certain features of the Service.

A. Consent

BY USING OR ACCESSING THE SERVICE, OR BY PERMITTING YOUR CHILD TO ACCESS THE SERVICE, YOU ARE ACCEPTING THE PROVISIONS OF THIS PRIVACY POLICY.

Children under the age of 13 (“Child”) are not allowed to use the Service without a Parent’s verified consent. Children under the age of 13 also may not subscribe to or create their own account with 77X. Children may only have a Child account that is established by, and with the verified consent of, a Parent.

As a Parent, you should know that through the Service your Child may participate in activities that involve the collection or use of PII, including, but not limited to Contests. However, children may not participate in any Service activities without your prior, verified consent.

77X must have verifiable Parental consent before we collect and use your Child’s PII. We allow for verification by the Parent printing a consent form, signing it, and returning it to us by post/mail, or scanning and emailing it to us.

B. Notification Efforts

We will ensure that before we collect any PII from a child, the child’s Parent receives notice of, and consents to, our information practices as described in this Privacy Policy.

C. Collected Information

We collect information for both individuals under the age of 13 and for those over the age of 13. This information is collected in the same manner regardless of age, but in the instance of a Child, only with the Parent’s consent.

D. Tracking Activities on the Service

When your child is logged into his or her account, we may track your child’s activities within the Service. This information is associated with your child’s account and may be combined with PII we collect from him or her.

We may partner with third parties to provide content, organize and/or administer Contests, and/or display targeted advertisements. We will not share your Child’s PII with these third parties without Parental consent. However, some of these third parties may use tracking technologies such as Cookies or Pixel Tags, in order to track user activity. We do not exercise control over or have access to these tracking technologies or the information practices or these parties, which are subject to the privacy policies of the relevant third parties.

E. Review, Delete, or Alter

Parents may request from us the types of PII we collected about their Child, view their Child’s information, and, if they choose, prohibit us from making further use of their Child’s information.

You can review your Child’s PII at any time by logging into their account or profile. You may remove access from your Child or delete your Child’s account entirely. You can also have your Child’s PII deleted and refuse to permit further collection of such PII by us.

If you wish to view, delete, or modify the PII we have collected about your Child or delete your Child’s account or profile, you may do this by logging in to your account at any time, or by emailing us at privacy@77X.world.

F. Parental Controls

We provide Parents many tools to monitor and supervise their Child’s activities with the Service. For example, we allow parents and guardians to edit their Child’s profile, turn on and off notifications, monitor all postings to the Service by their Child. Parents should always closely monitor their Children’s use of the Service.

13. Text Message and SMS Marketing

If you choose, you can opt in to receive text message alerts from us (whether by providing your phone number or any other method that we, or one of our affiliates or partners, provide) to receive promotions, product announcements, and other marketing information from us. You agree that by providing your mobile phone number, you expressly consent to receive automated text and SMS marketing messages from us to the mobile phone number that you provide. We may send you these messages from time to time, on a recurring basis, as promotions, announcements, and other marketing information become available. Opting-in or providing your consent to receive these messages is not required for you to use the Service generally.

We may share your mobile phone number with service providers with whom we contract to assist us with the above activities, but we will not share your mobile phone number with third parties for their own marketing purposes without your consent. Text Messages are distributed via third party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on your mobile carrier, it may not be possible to transmit the text message to you successfully; nor is content available on all carriers. We do not claim or guarantee availability or performance of this service, including liability for delays in transmission or message failures.

At any time, you can opt-out of receiving these messages by replying “STOP” to any such message that we send you.

14. General Privacy Rights and How to Exercise Them

You have the following rights with respect to our practices regarding your PII:

A. Right of Access. This is your right to be informed about what PII we are processing, why, and to whom we may disclose your data may be passed.

B. Right to Correction. This is the right to have your PII corrected or amended if what is held is incorrect in some way.

C. Right to Deletion. Subject to certain exceptions, and limitations, this is the right to have your PII deleted.

D. Right to Data Portability. This is the right to ask for your PII to be provided to you in a structured, commonly used, and machine-readable format.

E. Right to Non-Discrimination. In the event that you exercise one of your rights described in this policy, you will not be discriminated by us in any way, including by the denial of goods or services, providing you a different level of goods or services, or charging you different prices or rates for the goods or services, unless the change in price is reasonably related to the value we receive from your PII.

F. Right to Opt-Out of the Sale of Your Information. We do not sell your PII (whether “for money” or “something else of value”), but if we did, you would have the right to opt-out of such sale at any time.

G. Right to Opt-Out of Profiling. You may opt-out of ‘profiling’ (using solely automated processing of PII to make decisions that produce legal or similarly significant effects concerning a consumer). To the extent that the Company engages in ‘profiling’ you have the right to opt out of it.

H. Right to Opt-Out of Targeted Advertising. You may also be able to opt-out of targeted advertising based on your activity on non-affiliated websites and services. Please be aware, if you do exercise this right, you may still see generic ads on the Site and targeted ads based on your activity with the Company.

I. Right to Limit the Use and Disclosure of Sensitive Personal Information. You have the right to limit our use and disclosure of your Sensitive Information to what is strictly necessary to provide you with the Services and as otherwise permitted by applicable law or regulation. Please note, limiting our ability to use and disclose Sensitive Personal Information may affect our ability to provide Services and/or to allow you to participate in our Contests.

J. Exercising Your Rights. To exercise any of your rights under applicable privacy laws, please contact us at 877-779-7964 or privacy@77X.world with “Privacy Rights Request” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note, we may take additional steps to verify your information.

K. Right to Appeal Any Denial of Your Rights. If we should deny your privacy right request, you may submit an appeal of that determination via email to privacy@77X.world. In the subject line of your appeal email, please include the file number provided with the initial denial of your privacy right request and the word “APPEAL”. In the body of your appeal email please detail (1) the nature of your request, (2) your state of residence; and (3) your reasoning for why the initial denial should be reversed. In the event we deny your request for appeal, you may be able to file a complaint with the Office of the Attorney General in the State in which you reside, please consult the website of your applicable Attorney’s General for more information.

15. EEA Privacy Rights

If you are currently residing in the EEA and use the Service, the GDPR applies to your Personal Data, and you are a Data Subject. The GDPR requires that we, as a Controller, have a legal basis to process your Personal Data.

A. Personal Data Processing

We process your Personal Data under one or more of the following legal bases:

  • Processing is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
  • To perform the contract that we are about to enter with you (e.g., our Terms of Service);
  • To comply with a legal obligation; and/or
  • If we have your consent to do so (which you have the right to withdraw at any time).

B. Your Rights

In addition to the rights described in Section 14, under the GDPR, as a Data Subject you have the following rights:

  • The right to be informed. This is your right to be informed about what we are processing, why, and who else the data may be passed to.
  • The right to restrict processing. This is the right to ask for a temporary halt to processing of your Personal Data, such as in the case where a dispute or legal case has to be concluded, or the data is being corrected.
  • The right to object. This is the right to object to further processing your Personal Data if such processing is inconsistent with the primary purposes for which it was collected.
  • Rights in relation to automated decision making and profiling. This is the right to not be subject to a decision based solely on automated processing.
  • Right to Judicial Remedy. Notwithstanding anything to the contrary in this Privacy Policy, if you feel that we or one of our processors, if any, have infringed your rights under the GDPR, or that we are otherwise not in compliance with the GDPR with respect to your PII, you may bring a legal proceeding against us in a court (or file a complaint with a supervisory authority) located in the EEA country where you regularly reside.

C. Third Countries

In the event that we share, or otherwise transfer, PII covered by the GDPR and this Privacy Policy to a third party, or a country outside the EEA and/or UK, as applicable, which does not have an adequacy decision from the European Commission, or similar designation from the Information Commissioner’s Office, or similar regulatory authority (collectively, a “third country”), we will only do so if: (i) that third party, except in cases of government or law enforcement agencies, gives us contractual assurances that it will comply with the GDPR; and (ii) to the extent necessary, have in place a GDPR compliant procedure in place to protect the transfer, e.g. GDPR standard contractual clauses, available here, including any necessary assessments of the applicable third country, and supplemental measures designed to ensure you have essentially equivalent rights and remedies as you would in the EEA.

D. Privacy and Electronic Communications Regulations

In addition to the UK GDPR, the Privacy and Electronic Communications Regulations (“PECR”) provides additional substantive rights to Data Subjects residing in the UK.

We offer users of the Service the option to sign up to receive the Company’s dedicated email and SMS contact list that provides users with promotional materials, exclusive sales, newsletters, and additional marketing materials. You may remove yourself from this dedicated email list at any time by either selecting “unsubscribe” to the relevant email, following the directions to opt-out of SMS notifications, or adjusting your preferences in your account settings. We will not send the above-described marketing materials to any user unless they have opted into the dedicated email and SMS list, or to any user who has opted out of the dedicated email and SMS list after previously consenting to be included in said list.

As described in Section 10, we utilize Cookies and Pixel Tags. Cookies and Pixel Tags that are labeled “strictly necessary” or “essential” are essential for enabling the basic functionalities of the Service. BY USING THE SERVICE, YOU CONSENT TO OUR USE OF ESSENTIAL COOKIES AND PIXEL TAGS AS DESCRIBED IN THIS PRIVACY POLICY. Upon creating an account, or upon the first time you use the Service without logging into an account, we will provide you the opportunity enable or disable non-essential Cookies and Pixel Tags. Disabling non-essential Cookies and Pixel Tags may affect your experience with the Service. You may alter your selection at any time within your account settings.

16. California Consumer Privacy Rights.

To the extent that the CCPA applies to the Service with respect to your Personal Information, and you currently reside in California, the CCPA provides you, as a Consumer, with certain rights (in addition to those found in Section 14 above, specifically, the rights to be informed, to access, to correction, automated decision making/profiling, and to portability). If you are between the ages of 13 and 16, you hereby agree and consent to the use and disclosure of your Personal Information as described in this Privacy Policy.

A. Right to Know

Consumers have the right to request that we disclose Personal Information we have collected about them in the previous 12 months including, but not limited to, the categories of information collected by us, the source(s) of such information by category, and the purpose for collecting such information. This right may not be exercised more than twice in a 12-month period. In the previous 12 months, we have collected the following categories of Personal Information about consumers:

  • Identifiers. Identifiers can be your name, mailing address, date of birth, unique personal identifiers (device identifier, IP Address, Cookies, beacons, pixel tags, mobile ad identifiers), account names, and similar information. We collect the identifiers from the consumers themselves, third parties and automatic means;
  • California Customer Records (Cal. Civ. Code §1798.80) (“CCRLPI”). CCRLPI data is largely the same as Identifiers;
  • Characteristics of Protected Classifications. Protected classification information includes your gender, date of birth, and gender identity;
  • Commercial Information. Commercial information includes records of personal property, products or services purchased, obtained or considered, or other purchased or consuming histories or tendencies;
  • Geolocation Data. Such geolocation data may include GPS data or your approximate location data based upon your registration for, or check in at, an in-person event, activity, or Contest that we host or sponsor, or in which we participate;
  • Employment Information. Such employment information can include your employment history;
  • Internet/Network Activity. Internet Activity Information includes browsing history, Cookies, search history and a consumer’s interaction with a website;
  • Sensitive Information. Such as our users’ gender and/or gender identity and Personal Information about children under the age of 16, including their Identifiers, CCRLPI, gender, and/or gender identity; and
  • Inferences. Inferences drawn from any other category of Personal Information.

We collect Personal Information in the above categories from the consumers themselves, other users of the Service, service providers and business partners, third parties, and by automatic means for the purposes described in this Privacy Policy, and as required to comply with applicable law.

B. Right to Know

As a Consumer, you also have the right to request that we tell you which of your Personal Information we have disclosed for a business purpose, Sold, and Shared (each, as defined in the CCPA) in the previous 12 months. With respect to Personal Information being disclosed for a business purpose, the consumer shall receive the categories of information disclosed and the types of entities they have been disclosed to. This right may not be exercised more than twice in a 12-month period. For Personal Information being Sold or Shared this includes the categories of information being sold and the categories of third parties to whom it is being sold. In the past 12 months, we have disclosed and/or Shared Personal Information falling under the following CCPA categories:

  • Identifiers;
  • CCRLPI;
  • Protected Class Information;
  • Geolocation Data;
  • Employment Information;
  • Internet/Network Activity;
  • Sensitive Information; and
  • Commercial Information.

We disclose and Share Personal Information in the preceding categories to the Consumers themselves, to their Parent (if applicable), to other users/third parties as the consumer may direct, service providers, unaffiliated individuals and organizations with whom we partner for different events, programs, and activities (including, but not limited to Contests), and government/law enforcement agencies for the purpose it was provided/provision of Services, to comply with applicable law, and as otherwise described above in this Privacy Policy.

IN THE PAST 12 MONTHS WE HAVE NOT SOLD, AND DURING THE PERIOD OF TIME WHICH THIS PRIVACY POLICY IS POSTED WE SHALL NOT SELL, THE PERSONAL INFORMATION OF ANY CONSUMER, INCLUDING MINORS UNDER THE AGE OF 16.

C. Shine the Light

California law also allows its residents to request information regarding our disclosures to third parties in the prior calendar year, if any, of their personally identifiable information. To make such a request, please contact us at privacy@77X.world with “Shine the Light” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within 30 days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing. Our disclosure to you will only include information covered by the law.

17. Nevada Privacy Rights.

If you are a Nevada resident, you have to the right to opt-out of the “sale” of your “covered information” as such terms are defined in Chapter 603A of the Nevada Revised Statutes (“Nevada Privacy Law” or “NPL”). For the avoidance of doubt, we do not “sell” your “covered information”. Nonetheless, Nevada residents may submit a request to prohibit such sales by contacting us at privacy@77X.world. Additional information on the categories of personal information collected and categories of personal information shared with third parties can be found in this Privacy Policy. If you would like to tell us not to sell your information in the future, please email us at privacy@77X.world with your name, postal address, telephone number, and email address with “Nevada Do Not Sell” in the subject line.

18. Changes to this Policy

Because our business needs may change over time, we reserve the right to modify this Privacy Policy. If at any time in the future we plan to use your PII in a way that differs from this Privacy Policy, we will revise the Privacy Policy as appropriate. In the event of a change to this Privacy Policy, we will email the updated policy to the email address that you provided to us. Your continued use of the Service, or other means of legal acceptance, following our notice of changes to this Privacy Policy means you accept such changes. Please refer to the “Effective Date” above to see when this Policy was last updated.
